Description

In the context of the present debate about a reform of Competition Law, the author requests to reformulate another theoretical framework in accordance with the recent fourth technological revolution that occurred at the beginning of the third millennium of mankind's civilization, in which humans have developed a collection of modern technologies that disrupted economic organization. For the author to achieve this legal development, it must be realized that firms, markets, and monopolies are not real, but refer to abstract models that explain how economic reality works. Hence, in the new definition of platform market dominance for the platform economy, the 'Platform Ecosystem' must be understood as a novel meta-organization different from the traditional ones of firm and market. Likewise, it is necessary to differentiate between: market dominance about intra-platform competition, which refers to when the platform operator holds market dominance inside the Platform-Ecosystem. And market dominance about inter-platform competition, in which one Platform-Ecosystem holds market dominance when producers and consumers (the market) have coalesced around its digital infrastructure due to the existence of strong positive network effects.
